These Terms of Service ("Terms") govern your use of the MyMascada hosted service at app.mymascada.com and the MyMascada mobile apps for iOS and Android (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms apply to the hosted Service operated by us. If you self-host the open-source MyMascada software, your use of the software is governed by its open-source license instead.
1. The Service
MyMascada is a personal finance management tool that helps you track transactions, categorize spending, manage budgets, and view analytics. Some features rely on third-party providers (for example bank syncing via Akahu and AI categorization via OpenAI) and are subject to the availability of those providers.
2. Not Financial Advice
MyMascada is an informational tool only. Nothing in the Service constitutes financial, investment, tax, accounting, or legal advice. Categorizations, analytics, projections, AI-generated suggestions, and any other output are provided for general information and may be inaccurate or incomplete. You are solely responsible for your financial decisions, and you should consult a qualified professional before making decisions that depend on your financial data. We are not a financial adviser, bank, or other regulated financial-services provider.
3. Your Account
- You must provide accurate registration information and keep it up to date.
- You are responsible for safeguarding your password and for all activity under your account.
- You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.
- Notify us promptly at support@mymascada.com if you suspect unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, including money laundering or fraud;
- Access or attempt to access another user's account or data without authorization;
- Probe, scan, or test the vulnerability of the Service, or circumvent authentication or security measures, other than through our coordinated disclosure process;
- Interfere with or disrupt the Service, including by imposing an unreasonable load on our infrastructure, scraping, or automated bulk access;
- Reverse engineer the hosted Service (the open-source code is available separately under its license);
- Resell, sublicense, or provide the hosted Service to third parties without our written consent;
- Upload malicious code or content that infringes the rights of others.
5. Your Data
You retain all rights to the financial data and other content you submit to the Service. You grant us a limited license to host, process, and display that data solely to provide the Service to you. Our handling of your data is described in the Privacy Policy. You can export your data and delete your account at any time from within the app.
6. Bank Connections
Bank syncing is provided through Akahu and is currently available for New Zealand banks only. By connecting a bank account you authorize us to retrieve account and transaction data through Akahu on your behalf, subject to Akahu's own terms. We do not receive or store your bank login credentials. Synced data may be delayed, incomplete, or inaccurate; always rely on your bank's own records as the source of truth.
7. Subscriptions and Fees
The Service may offer free and paid plans. Prices, plan features, and billing terms are presented at the point of purchase. Where purchases are made through the Apple App Store or Google Play, the respective store's billing terms and refund policies also apply. We may change pricing with reasonable advance notice; changes take effect at your next billing cycle.
8. Termination
- By you: you may stop using the Service and delete your account at any time from within the app.
- By us: we may suspend or terminate your account if you materially breach these Terms, if required by law, or if we discontinue the Service. Where practicable, we will give you reasonable notice and an opportunity to export your data.
- Upon account deletion, your data is removed as described in the Privacy Policy.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data (including bank-synced data and AI-generated categorizations) will be accurate or complete.
10. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) NZD $100.
Nothing in these Terms excludes or limits rights you may have under consumer protection laws that cannot be excluded by agreement, including, for New Zealand consumers, the Consumer Guarantees Act 1993 where it applies.
11. Indemnity
You agree to indemnify us against claims, liabilities, and expenses arising from your breach of these Terms or your unlawful use of the Service, to the extent permitted by law.
12. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. For material changes to the Terms we will give notice in the app or by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the courts of New Zealand, except where the law of your country of residence grants you mandatory protections or a different forum.
14. General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
